Public Information Requests


 

The Texas Public Information Act (Texas Government Code, Chapter 552), formerly the Texas Open Records Act, gives the public the right to access government records.  All governmental information is presumed to be available to the public, although certain exceptions may apply. Governmental bodies will release requested information as promptly as possible, unless the information is exempt from disclosure under the Public Information Act.  

Texas Government Code §552.223 dictates that Municipalities must treat all requests uniformly. In the City of Rollingwood, all written requests for information are treated as public information requests. 

A Request for Information must be filed with the City Secretary's Office. Though filling out the Public Information Request form is not required, we suggest citizens use the request form to ensure that the request if properly filled out, routed and tracked by city staff. In order to ensure that your receive the requested information as quickly as possible, remember that all requests must meet certain guidelines:  

  • Requests must be submitted in writing.  Verbal requests will not be accepted. 
  • Requests must seek documents or data that are in existence at the time of the request.  The PIA does not require the City to analyze information, create new documents, or answer questions. 
  • Certain sensitive information is exempt from release to the general public, and the City is Required to withhold it under the PIA.  This includes Social Security numbers, certain financial information, documents and information relating to an ongoing criminal investigation, certain information relating to minors, and information subject to the attorney client privilege.  Request for this type of information will usually be referred to the Texas Attorney General's Office for determination on whether or not the information can be released.  

The City is entitled under the PIA to recover the costs associated with fulfilling a request.  Requests that are properly submitted will generally be responded to within ten (10) business days.  All questions relating to the Public Information Request process should b​e forwarded to the City Secretary's Office.  Please click HERE to contact the City Secretary regarding a Public Information Request.
